Whether you are thinking to sell, buy, develop, or lease a property, a real estate attorney can prove to be of valuable assistance for making sound decisions by guiding you in the right direction. An attorney who is well-versed and experienced in handling real estate cases will be able to provide you with not only litigation services, but also advise you regarding financing options, market, trends, and take care of legal issues involved in making, negotiating, and deploying contracts.

The following are some ways in which a real estate attorney can help you with your real estate investments and related legal issues:

Negotiations

Since real estate attorneys have experience in dealing with different types of real estate transactions, they are able to negotiate the terms and conditions more effectively in real estate deals. They deal with developers, investors, brokers, and other attorneys, which otherwise can be daunting for you.

Property Transfers

The process of preparing contracts and negotiation becomes quite complex when one or more parties involved in the transaction are partnerships, trusts, or corporations. Each of these business arrangements has different ways of settling real estate matters. An experienced attorney knows how to deal with them, while staying within the legal boundaries of their state. With a real estate attorney, you can be sure that the contract is in line with the state’s law, and the terms and conditions of the deal don’t violate the charter agreements of other parties involved in any way.

Document Drafting

Document drafting is one of the key roles of a real estate attorney. They help in preparing rental and lease agreements, deeds for conveyance transactions, financing agreements, and purchase contracts. While a real estate agent can help you fill these documents as well, only a licensed attorney can draft them, and help you make sure that they are in line with your interests, and make revisions to it accordingly.

Filings

Often times, real estate deeds are required to be filed at the state level. With an attorney, you can have this task done in no time, without any hassle. Moreover, they can also help you in completing transactions involving certain types of construction which are not permitted by digging up state regulations and finding the right solution.

Foreclosure

Some real estate attorneys have experience in dealing with trust deed and mortgage foreclosures, especially during harsh economic times. Most lawyers are capable of representing both borrowers and lenders. In case of borrowers, they try to prevent foreclosure by negotiating a settlement agreement with the lender or by carefully studying the case and pointing out any mistakes the lender made in the process. In case of lenders, they make sure that the lender don’t make any mistakes during the foreclosure process, and help them in filing a lawsuit.

I’ll keep in mind that only a licensed attorney can draft documents. A few years ago we didn’t agree to a finance on the house and we had to go to court. Next time we will be sure to check the licensing for our next attorney!

I like what this article mentions about the filings and how a real estate attorney would be able to do them quickly. It makes sense that with how much knowledge and experience an attorney would have, the paperwork and filings would get done a lot quicker and more effectively. It’s something I’ll have to keep in mind to make sure that when I buy a house, the process will go smoothly and have minimal mistakes or hiccups.
